1. Who offers this programme
The person responsible for processing your personal data is FOODLUS SOLUTIONS SL, who acts as a loyalty and data storage service provider.
However, the business Retro food where you registered in the loyalty program will be the one who uses your data for commercial purposes, such as sending promotions, offers and personalized communications.
This loyalty programme (hereinafter, "the Programme") is offered by the entity identified above (hereinafter, "the Establishment").
2. What the Programme is
The Programme is a customer club. By joining, you earn points for your purchases, obtain rewards and receive the Establishment's promotions, offers and news. Receiving those communications is part of the Programme: it is one of the benefits you obtain by signing up.
You can stop receiving them at any time, free of charge, without having to leave the Programme.
3. Who can take part
Natural persons aged 18 or over who complete the registration form with accurate information may take part. Participation is free and voluntary.
Each person may hold only one account. The account and the associated digital card are personal and non-transferable.
4. How it works
When you register you receive a digital card that you can add to your mobile wallet (Apple Wallet or Google Wallet). That card identifies you at the establishment.
Earning. For each purchase you earn points according to the exchange rate in force, which is shown on your digital card and at the establishment itself. For points to be earned, you must identify yourself at the time of payment by showing your digital card or providing your telephone number. Points are not earned retroactively if you did not identify yourself when paying.
Redemption. You can redeem your points for the rewards published at any given time, once you have reached the points required. The rewards in force, their cost in points and their conditions are shown on your digital card and at the point of sale.
Exclusions. The Establishment may exclude certain items from earning points, such as tips, surcharges, products already discounted or food and drink obtained through a reward. The exclusions in force are indicated alongside the Programme conditions at the establishment.
The Programme does not handle payments. No bank details or payment card details are requested or stored.
5. Validity of points
Points do not expire as long as the Programme remains in force and your account remains active. If an expiry period were to be introduced in the future, it would be communicated with the notice period set out in clause 8.
Points have no monetary value, cannot be exchanged for money, cannot be sold or transferred to another person, and cannot be combined with other promotions unless otherwise stated.
6. Errors and reversals
The Establishment may correct or reverse points earned or redeemed that were recorded in error, provided it informs you. If you notice an error in your balance, you can raise it at the establishment itself or by writing to the contact email given at the top.
7. Misuse
The Establishment may suspend or cancel your participation, after notifying you, in the event of fraudulent use of the Programme: earning points using other people's or non-existent receipts, creating several accounts for the same person, identity theft, tampering with the system or handing over the account to third parties.
In such cases, points obtained irregularly may be cancelled. In any event, you retain your right to make a complaint.
8. Changes to the Programme
The Establishment may change these conditions, the points exchange rate or the rewards catalogue for justified reasons, such as changes to its offering, its costs or the applicable legislation.
Changes will be communicated 30 days in advance by email or by notification on the digital card. During that period you will be able to redeem your points under the previous conditions or leave the Programme at no cost. Changes will not apply retroactively to points already earned.
9. Leaving the Programme and termination of the Programme
You can leave the Programme at any time, free of charge, by writing to the contact email given at the top or via the link included in the communications you receive. Leaving the Programme means losing any unredeemed points.
If the Establishment decides to terminate the Programme, it will give 60 days' notice, during which you will be able to redeem the points you have earned.
10. Communications you will receive
As a member of the Programme you will receive:
- Notices about your account: registration confirmation, points balance and a notice when you reach a reward.
- Promotions, offers and news from the Establishment, including birthday greetings and reminders if it has been a while since you last visited.
All commercial communications include a free unsubscribe link. If you use it, you stop receiving promotions but remain in the Programme and keep your points.
Mobile notifications. These are delivered by your phone's digital wallet. You will stop receiving them if you remove the card from your wallet or if you restrict notifications in your device settings. Removing the card does not mean leaving the Programme or unsubscribing from emails.
11. Liability
The Establishment is responsible for the Programme and the rewards. It is not liable for service interruptions beyond its control, nor for any inability to receive notifications arising from the settings of your device or your digital wallet.
Nothing in these conditions limits the rights granted to you under consumer protection legislation.
12. Data protection
The processing of your data is governed by the Programme's Privacy Policy, which forms part of these conditions.
13. Governing law and complaints
These conditions are governed by Spanish law. As a consumer, you may bring a claim before the courts of your place of residence.
